{"id":3464,"date":"2026-07-27T17:38:00","date_gmt":"2026-07-27T17:38:00","guid":{"rendered":"https:\/\/delplatagreen.com\/?p=3464"},"modified":"2026-07-27T17:38:01","modified_gmt":"2026-07-27T17:38:01","slug":"multas-ambientales-por-que-medir-y-reportar-a-tiempo-reduce-riesgos","status":"publish","type":"post","link":"https:\/\/delplatagreen.com\/en\/multas-ambientales-por-que-medir-y-reportar-a-tiempo-reduce-riesgos\/","title":{"rendered":"Environmental fines: why measuring and reporting on time reduces risks"},"content":{"rendered":"<p class=\"wp-block-paragraph\">This week we participated in the talk <strong>\u201cEnvironmental fines: keys to understanding their calculation and preparing a better defense\u201d<\/strong>, in charge of Katherine Andrea Melgar T\u00e1mara and Gabriela L\u00f3pez.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The meeting addressed the new methodology for calculating fines of the Environmental Assessment and Enforcement Agency \u2014OEFA\u2014 of Peru, applicable to procedures initiated from March 28, 2026.<\/p>\n\n\n\n<h2 id=\"las-multas-como-mecanismo-economico\" class=\"wp-block-heading\">Fines as an economic mechanism<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the central concepts was the internalization of negative externalities. In other words, that the environmental cost generated by an activity should no longer be absorbed by society but returned to the producer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new methodology is based on the following formula:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>B\/p \u00d7 (1+F)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In it, the illicit profit is divided by the probability of detection and then adjusted by various grading factors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fine thus ceases to function solely as a symbolic sanction and begins to consider the economic benefit obtained by non-compliance.<\/p>\n\n\n\n<h2 id=\"que-se-entiende-por-beneficio-ilicito\" class=\"wp-block-heading\">What is meant by illicit gain?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Illicit gain may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Income obtained improperly.<\/li>\n\n\n\n<li>Costs avoided by not fulfilling an obligation.<\/li>\n\n\n\n<li>Costs postponed over time.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This means that what a company did not invest in measurement, monitoring, prevention, or remediation can later become the economic basis for the penalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The supposed savings generated by not acting in time ceases to be an advantage and becomes part of the calculation of the fine.<\/p>\n\n\n\n<h2 id=\"el-valor-del-autorreporte\" class=\"wp-block-heading\">The value of self-reporting<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most striking aspects of the methodology is the role of the probability of detection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since this variable appears in the denominator of the formula, a higher probability of detection can reduce the amount of the fine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The category <strong>\u201cvery high\u201d<\/strong>, The equivalent of 100 % includes certain self-reported non-compliance issues prior to an inspection.
